Execution of judgments

The new Saudi Execution/Enforcement Law, issued by Royal Decree No. M/53 dated 3 July 2012 (13.08.1433 AH) is now in effect from March 2013 in the Kingdom of Saudi Arabia (KSA). It regulates the enforcement of judgments of the Saudi Courts in Saudi Arabia.

The new execution Law i provisions that affect all aspects of executing local and foreign judgments, as well as foreign arbitral awards, in KSA. All local and foreign companies and individuals operating in KSA or doing business with KSA entities are controlled by this law under the jurisdiction and powers of Execution Judges. The Execution Judge plays a key role in the enforcement of civil judgments and awards in KSA.

According to Article 1 of the new execution Law, the Execution Judge is responsible for the enforcement of all judgments and awards in KSA (except administrative and criminal cases). The Execution Judge is supported by law enforcement officers and is required to follow the enforcement procedures outlined in the local Shari’ah (Islamic law) principles unless the Law stipulates otherwise.

In case when a successful plaintiff is not able to obtain a voluntary settlement from a defendant, it will be necessary to enforce a judgment or other legal right capable of execution through an application to the appropriate Saudi Execution Court for execution order. It is generally necessary to produce written evidence based on a claim to the Execution Court that the applicant has first tried to obtain a voluntary settlement from the debtor. The court execution order in Saudi Arabia may include the recovery of property or other assets subject to a judgment, the vacating of real property, or the confiscation or sale of funds or property.
